As much as I am fed up of General Musharraf he is still the lesser of three evils; the MMA, Nawaz Sharif and Benazir Bhutto. Who then is it that will take the reins of the nation?

The PPP ex-PMs are salivating at the thought of ``democracy``

Pakistan`s hard currency reserves are at an all time high. The Paki Rupee has been stable for seven years. The economy is growing at fantastic rates. There is a construction boom in Karachi. Work is starting on Pakistan`s fourth port at Somniani. (T)

All this is happening on the Mohajir dictator`s watch and his Mohajir PM`s administration. The exiled ``democratically-elected`` PPP ex-PMs are salivating at the prospect of returning and feeding at the trough with both mouths.

I try to fight for this cause and others all over the place - apparently not very effectively. :)
I am so concerned about these poor people`s plight, that many, especially on Chowk, call me a ``Bihari,`` in their derogatory manner to trivialize and dismiss this important issue. But then I have been called an Ahmedi, a ``Mirzaee,`` a Dalit, a Hazaara, an American Injun, a Bahai, an Ismaili, an Afro-American, and even a Jew. :) Of course, I am not any of these, but if it makes people feel better or superior, I will concur. :)

Being the most despised person on Chowk, it is not important whether I am right or wrong. What`s important is that the injustices against the ``stranded`` yet loyal and brave Pakistanis in BD be corrected. Also, the pernicious provincialism, hegemony, and discrimination must be recognized and eradicated. Of course, you and I agree on the secular, liberal, peaceful, democratic, and just social and political environment needed for Pakistan.

Thank you, my friend, for recognizing the problem. The hopes and dreams of sincere Pakistanis are with you. Too bad, the overwhelming majority of Punjabi Pakistanis, especially on Chowk (e.g. Tahmed32, Ali_1, Atif2, Sobia, Ally, Khamkhwa, Zeemax, and many others) don`t share your objectivity.

In defense of his horrendous Constitutional Illegalities it is good to see that Musharraf finally breaks down and confesses on GEO TV (after ransacking it 3 days earlier) -- that he is indeed an illegal man -- that is -- an illegal president -- and that he is a simple soldier -- undeserving to be the COAS of Pakistan by any criteria. Bravo!

His name is not Bhagwan but Bhagwan Das, which means ``Servant of Bhagwan``, much like the muslim name Abdullah (``Servant of Allah``). It is a very nice Sanskrit name.

Having said the foregoing, Bhagwan Das is as Pakistani as anyone else who lives in Pakistan-- aka Aryadesh in Sanskrit ;)-- so I hope that he will act in the best interest of his home-land and the home-land of his anscetors.

Anarchy in Pakistan will serve noone except those who are motivated by bigtory and those who harbor hatred in their hearts.

so folks -- this looks like the kurwat ooNt baithay gaa -- the consensus is that CJ Iftikhar Chaudry will be reinstated but he will be debarred from ruling on any Musharraf related court cases like, uniform, election by present NA, tenure, double-dipping etc etc.

Now one will have to admit that this is one creative justicizing solution to keep Supreme Court off the back of a compulsive institutional hijacker -- courtesy once again -- the peerless pirzada

Question is -- is it possible to debarr a Chief Justice of the Supreme Court from catching the one and the only miscreant -- in this one man miscreant show?

Waqt pe gadhey ko baap maanna jaayez hai - Message to Mohajirs

Dear Urdu-speaking Mohajirs,

I have no political ambitions in Pakistan and certainly not in Lahore. You have noticed the constant altercation between various Pakistani Punjaibis and me. My main interest in retaliating forcefully against these bigots, racists, and supremacists is to expose them in your eyes.

In real life, most of you have probably suffered from discrimination at the hands of these selfish people in matters of education, employment, and commerce. What you have probably not contemplated is the level of their hatred, prejudice, and profanity. Well, here on Chowk, in the safety of anonymity, these people have the opportunity to express their true feelings without consequence. You have read cruel and lewd racist, ethnic, and linguistic insults from Ali1 and Atif2. You have witnessed the murderous intentions and hateful expressions of Punjaibi supremacy from Sobia and Khamkhwa. Even Manto, Ally, and Aashee have used thinly-disguised methods of insulting those whose native language is Urdu and whose ancestors came from Hindustan.

But, the worst offender and most hateful representative of Punjaibi behavior is Tahmed32. This hypocrite has openly and vehemently opposed the repatriation of Pakistanis ``stranded`` in Bangladesh. He, among other Pakistani Punjaibis, uses the term ``Bihari`` as a racist and condescending means to lump all Urdu-speakers together and justify discrimination and injustice against us.

The point of my message is that we should open our eyes, be alert, keep our powder dry, and not let these hatemongers reenact their murderous acts against our poor, defenseless people. Don`t forget that it was the mainly Pakistani Punjaibi-dominated army that massacred many Pakistanis in East Pakistan. It was this same Pakistani-Punjaibi dominated army that shamelessly surrendered in droves and the cowards were escorted to safety in India by their fellow Punjabis, mostly brave and compassionate Sikhs, of the Indian army.

The Pakistani Punjaibis drove the majority Bengalis out of Pakistan. They are looting the resources and killing the people of Baluchistan. They have killed in Karachi and continue to kill Pakistanis in NWFP. They have alienated the Kashmiris, especially the Gilgitis and Baltistanis. Even the Saraikis, who live in southern Punjaib, want to throw off their yoke.

Please understand the people you are up against. Let us not be fooled by them to make common cause with them against our fellow Pakistanis who suffer from their oppression. Please do not let them channel our frustration and anger against India, where many of our dear relatives live. India has never done anything to harm us intentionally - the devastating bombing of Karachi in `71 was not directly directed against us.

I agree that not all Pakistani Punjabis are evil. Yes, there are quite a few who see the stupidity and folly in their fellow Punjaibis` insatiable thirst for power and loot. Unfortunately, the most hateful and prejudiced Punjaibis seem to be in the majority and are certainly much more vocal here on Chowk.

Let us be united. Let us help each other. Let us develop a secular, democratic, and fair environment in the areas where we dominate and let`s get along with everyone - until our own freedoms, lives, and properties are threatened by these evil persecutors.

Mentioning specifically certain landmark cases, which instantly raised his stature as the adjudicating authority — enjoyed by nobody in the recent past — he talked about hearing petitions against rising oil and pharmaceutical prices involving the interests of large multinationals, preventing public parks being converted into exclusive (mini)golf clubs or commercial complexes, strictly enforcing building regulations and decreeing the demolition of elitist encroachments on public lands, prohibiting the cutting of forests in the construction of an elitist township known as New Murree in the foothills above Islamabad, instituting inquiries into disappearances, providing relief to rape victims, banning forced marriages and the exchange of girls and women to settle disputes according to local customs.

Last year, he also dealt a severe blow to the administration by annulling the privatisation of the largest industrial unit in Pakistan, the Pakistan Steel Mills. “The cases which were pending were the Gwadar land scam and certain constitutional issues. I was also going to look into the privatisation of the Habib Bank,” revealed Mr Iftikhar Mohammad Chaudhry.

In the last one year alone, he had taken suo motu notice of more than 6,000 cases of human rights’ abuse across the length and breadth of the country. In the two years since his elevation to that office the chief justice had cleared a massive backlog of cases and taken up, suo motu, several causes close to environmentalists and social reformers.

Shri Bag One Dash is from Sind (T)

Early life
Rana Bhagwandas was born on December 20, 1942 into a Hindu family in Sindh. He studied law and received a Masters degree in Islamic studies. He joined the bar in 1965 and after two years of practising law, joined the Pakistani Judicial System in 1967. Later, he became a sessions judge, and subsequently, a judge of the Sindh High Court. He is not a fan of cricket, but remains a supporter of the Pakistan cricket team.


Judicial career
Rana Bhagwandas was promoted to the Sindh High Court in 1994. In 1999, his appointment to the superior judiciary was challenged by a constitutional petition (no. 1069/1999) against the Government of Pakistan and Judge Bhagwandas. The petition demanded that the judicial bench consisting of Judge Bhagwandas should be declared unconstitutional because of Bhagwandas` religion, claiming that only Muslims can be appointed to the superior judiciary. The petition was rejected, and the petitioner was condemned by other judges of the high court and by a significant number of lawyers.

In 2000, he joined the Supreme Court of Pakistan after taking an oath of allegiance to Musharraf`s administration. Justice Bhagwandas took strong note of a kidnapping case involving a girl in NWFP forced to be a prostitute for four years. A believer in the sanctity of the Constitution of Pakistan and its legal system, Bhagwandas maintains that the law is equal for all religious communities in Pakistan. While staunchly defending Pakistan`s society and legal system against charges of bias and suppression of minorities, Bhagwandas is also a vocal opponent of the infamous practice of honour killings of women in the provincial rural areas.

For the 2006-2007 judicial year, Justice Bhagwandas is a member of the second bench of justices which also is home to Justice Nasir ul-Mulk and Justice Syed Jamshed Ali.

Chief justice
Justice Bhagwandas has served as acting Chief Justice twice - first in 2005 while Chief justice Iftikhar Chaudhry was on a ten day trip to the People`s Republic of China and then again in December 2006, when the latter was on a Haj pilgrimage. He was the first Hindu and the second non-Muslim (after A. R. Cornelius) to serve in this post. On February 8, 2005 Chief Justice Rana Bhagwandas was honoured with ``Siropa`` (robe of honour) during his maiden visit to Harimandir Sahib in Amritsar, India. He was on a private visit to Amritsar, Ropar and Chandigarh with Justice Khalil-ur Rehman Ramdev, another judge of the Pakistan Supreme Court and his wife. It is not clear if Bhagwandas will actually succeed Chief Justice Iftikhar Chaudhry though; Bhagwandas is slated to retire in December 2007, after attaining the age of 65, while Chaudhry`s retirement is slated for 2013.

On December 28, 2006 Bhagwandas became acting judge again while the Chief Justice Chaudhury was on hajj.

Recent Controversy
On March 9, 2007, Pakistan President General Pervez Musharraf declared Chief Justice Chaudhary ``non-functional`` and forwarded a reference against him to the Supreme Judicial Council (SJC) of Pakistan. While Justice Bhagwandas should have taken his place as Acting Chief Justice, his whereabouts remain untraceable at the moment. On March 15, 2007 a petition was filed in the Supreme Court urging the Pakistan Government to declare his whereabouts. There have been unconfirmed reports that he is being held incommunicado by the Government or is in the ``protective`` custody of Pakistan`s intelligence agencies. His brother, Sri Chand, in Pakistan says that Bhagwandas went on a visit to India and since then the family has not heard from him. It has since been learnt (March 20) that he is meditating in the Indian city of Lucknow, and is due to return to Pakistan on March 23. He is aware of events transpiring in Pakistan.

I am not too happy with Pakistani media and martial law government`s propaganda machinery projecting Justice Bhagwan Das as some kind of paragon of virtue and uprightness. Let us not forget that he is one of the judges who ``legitimized` this dictators coup d`etat and desecration of the Constitution. So instead of developing a personality cult for Bhagwan Das or even Justice Iftekhar, we must see how the judicial council acts out instead. The criterion for our judgement is that Justice Iftekhar is right and dictator is wrong. Any other outcome of this so-called judicial inquiry is unacceptable and travesty of justice.

It should be a point of interest to the readers here that, two of the judges in the judicial council panel are also the signatories of the reference against Justice Chowdery which should render them disqualified to sit on the panel. A petitioner cannot be a judge; it is a simple rule.

Also it must be noted that Judicial council has postponed CJ`s trial until first week of March. Martial Law propaganda machinery is spreading this disinformation that it was done at the request of CJ and his lawyer. Well his lawyer, Itezaz Ehsan has categorically denied this propaganda yesterday on TV.

As long as the electoral process and the ensuing results are peaceful, I am all for democracy. However, the brick throwing lawyers are not behaviing in too promising a manner. :(

And I am not much hopeful for India even. Here I am worried, someday, yes as you say, dalits and women would be killing rajputs and brahmins.

Islamabad, March 21 (PTI): The Pakistan government’s decision to resolve the judiciary crisis by making Rana Bhagwan Das the acting chief justice has sparked a heated debate on whether a non-Muslim can head the apex court.

Das, who returned today to Karachi from a pilgrimage in India, is the only Hindu judge in the Pakistan supreme court.

The judge had earlier held the acting chief justice’s post but this will be the first time he will take over after chief justice Iftikar Chaudhry was suspended. Das will head the five-judge Supreme Judicial Council currently hearing charges against Chaudhry.

As Das went for a long walk amid tight security soon after his arrival, moderates and hardliners crossed swords.

A leader of a faction of the Jamaat Uleman Islami, Maulana Sami-ul-Haq, criticised the move to make Das the acting chief justice. A non-Muslim cannot head the supreme court in an Islamic country as a non-Muslim cannot head the government, Haq said.

The Jamaat-ud-Dawa, a new outfit floated by Hafeez Saeed — the founder leader of the banned Lashkar-e-Toiba — echoed Haq. “It is against the Shariat to appoint Justice Rana Bhagwan Das the acting chief justice,” the organisation said in a statement issued by its leader Hafiz Adb-ur-Rahman Makki.

Makki said he held Das in the “highest esteem”, but asked: “How can a non-Muslim person take the oath of upholding Pakistan’s constitution, when the constitution is expressly bound to espouse the Quran and the Sunnah?”

While Pakistan’s constitution does not explicitly bar a non-Muslim from holding the post of the chief justice, some feel that the top judge also becomes the head of the Shariat court. Das is the only one among the supreme court judges who has a masters degree in Islamic law.

However, noted scholar and moderate Javed Ahmad Ghamdi contradicted both Haq and Makki, saying there were no restrictions or impediments in Islam to make a non-Muslim the head of the supreme court.

Veteran lawyer S.M. Zafar supported Ghamidi’s stand, saying there was no such bar in the constitution and cited the example of Cornelius, a Christian who was acting chief justice.

I am glad to hear and see these things... thank God people are finally coming to the streets and showing their unhappiness in a more civil way as opposed to bombing and stuff... Like PMishra said people have an interest in society and want the civil institutions to become stronger, because now we realise the need of these strong institutions... all we have to do is look across the border and see the advantages of democracy and strongish institutions...

I`m happy that we can look across the border and compare our lot and that so many ppl in Pakistan are doing that... Mushy took the p*ss with what he did, and it was all too much... he should step down from one of his positions now... i hope Rana Bhagwandas can do something here... i hope the steam doesnt come out of the sails for this one, and the press keeps this issue alive and burning as well as the lawyers... Nepal analogy is completely out of place. In Nepal there was only one avatar who could be removed after he lost favour of the people. In Pak the avatars of Allah are there on the streets killing each other, shiya killing sunnis, army killing separatists, militants killing civilians, mohajirs killing punjabis, punjabi killing all others except pathans who are left out for being killed in turn by the army on the behest of Nato. Even women have started wearing AKs now, of course for the wrong purpose. You see, when their brother mullahs were subjecting women to `better things than killing` (and then of course butchering them) no Kalashnikov and burka clad women came out of their libraries. So, people of Pak have no clear-cut objective. Here, you will find one avatar occupying the throne after the other. And that is natural too, land of pure being ruled by the incarnations of Allah. Finally some signs that civil society isn`t completely dead in pakistan. If Nepal can get rid of its king, who claimed to be avatar of vishnu!, surely pakistan can limit the military dictators? Its really a bizarre history so far, with dictator after dictator coming forward and managing the country.

Speaking as an indian, this kind of agitation is a much better sign of shared values and possibly a shared future than any char-anna pronouncements of politicians and military afsars. And, no, this kind of agitational chaos does not mean the country is falling apart. It actually means the exact opposite: that people are invested and involved in the system and are willing to fight for something.

It is true that people are just fed up. It was a mistake for musharraf to have allowed an independant media policy which has turned around and bit him.

The seeds of discontent had been there since about three years when the inflation hit, plus the FATA bombings, but there was nothing to bring people out on the streets. This issue has done what the previous could not. It is true about the last straw on the camels` back.

However the government is using the only tactic at its disposal, expectedly, of delaying tactics. Now the hearing scheduled for this week has been postponed till sometime in April.

I don`t know why HP is spinning such a yarn of it in his iLogs? He was never a conspiracy theorist ... why now?

Almost completely a rhetorical article. Without much substance. Many times the handwriting resembles that of someone like NS or BB in exile. Sometimes it looks like a school essay scribbled over the answer sheet by a 10th class student. Though a good one, 10 out of 10 type. Fine vocabulary, no grammatical mistakes and having a passionate opening and a forceful ending, spiced with a quotation from one of the greatest essayist of all time.

Unfortunately, words won`t serve any good to Pak. I see many planing parties after reading this one.

The Jadoogar, while the preparation of the reference was underway, was actually in Jeddah overseeing the revision of the OIC charter.

To anyone conversant with the legal skills with which he is endowed it is evident that he was not consulted in the matter. Had he been, things would not have come to such a sorry pass. As astutely and correctly noted by a fellow columnist in a Lahore-based newspaper writing on the mess that has been made by inefficient, if not downright stupid, advice.

“Another disturbing aspect is how blindingly clear it is that the deft hand of Sharifuddin Pirzada is absent. Never before has a military ruler attempted to fiddle with the judiciary without Pirzada masterminding the operation. He is a lawyer of both tremendous ability and vast experience . . . . [he] also always ensured that a legal footing, no matter how tenuous, was provided, which is not the case here.”

And again : Which hamfisted nincompoop ordered that the Chief Justice of Pakistan be kept under virtual house arrest and incommunicado from even the lawyers who are defending him? Which dysfunctional functionary ordered that the Chief Justice (regardless of what he should or should not have done) be waylaid when he set out for the Supreme Court and the reference hearing on March 13, and thus ensured that a photograph of his being manhandled – grasped by the hair on his head – by members of the police force be printed on the front page of one of our press publications?

And worse, which ‘information’ genius advised the general to call into his camp office on March 9 the press and the electronic media? We and the world could well have done without shots of a military general sitting with the Chief Justice of his country.

We need to know the answers if we are to come anywhere near understanding the whys and wherefores of the ridicule to which this nation is being held because one man has been misadvised, has not calmly thought out the issue, and has acted in undue haste.

``Now, it is up to the general to try and retrieve the situation. An editorial in The Times (London) gives due praise to Musharraf “for his resolute opposition to fanaticism” and “for his efforts to modernise Pakistan, not least by improving the appalling legal status of women . . . .”.

It points out “a signal error of judgment on his part” which has resulted in an uproar – his suspension of “the outspoken Chief Justice of the Supreme Court, Iftikhar Mohammed Chaudhry” on allegations of abuse of authority “whose substance has yet to be made public.”

It ends : “It is useless for the government to deny any political motive. Its action is almost universally seen as an attempt to tame the judiciary before elections this year under rules that are expected to come under legal challenge. President Musharraf must calm this storm . . . . Good Generals know when to retreat.”

Yes, they do, but then it is far more difficult to make the retreat than to advance. Few would have ‘gloriously’ retreated as Musharraf so wisely did on the day after 9/11.

This is a short column. Disgust and dismay prevents me from writing more. All we can do is murmur to ourselves “Let Good triumph over Evil.” (DAWN)

[HP has posited a cautionary thesis. But to agree or disagree with that thesis one has to have the insiders` extremely detailed knowledge of the nation`s ruling system. I am hoping he is wrong on this one.]

Well-written article, but a lot of brave words and plenty of cricket, nihari, and ammi jaan.

Nobody in his/her right mind would advocate dictatorship - especially a military one. Everyone wants democracy, but there is no quick fix, no cheap freedom, and no instant cure for insanity. Pakistan has NEVER experienced a sustained even limited democracy. Jinnah was basically a universally-accepted autocrat, a one-man show, who needed no ratification of his whimsical ideas. Muslims have an uncanny habit of elevating even the most mediocre of their leaders to positions approaching divinity.

Democracy means much more than mob rule. Majority rule does not mean that a vote can decide the life or death of any hated minorities, confiscation of their wealth, or designation of their community as non-Muslim, naPaak, or discrimination against them in employment, business, or education. There must be concrete, sacred, and inalienable rights assured to ALL citizens - such as in the Bill of Rights. There must be protection for smaller states/provinces, otherwise Delaware would have never joined the United States.

Pakistan has had only two orderly, legal, and fair transitions of power. The first was in the `50s when the Bengali-dominated Awami League and Suharwardy beat the incumbent Muslim League. The second was when an Urdu-speaking Mohajir COS, Mirza Aslam Beg, transferred power to a victorious Benazir Bhutto in 1989. Forget the fact that Gen Aslam Beg was an imbecile when it came to knowledge of military matters - he was the fool who considered helping the Bosnians achieve military success as a futile effort and bound for failure. But he did supervise fair elections and did not grab power for himself - unlike Ayub, Yahya, Zia, and Mushy.

The question to ask is what replaces Mushy in the future? Another two rounds of twiddle dee and twiddle dum will not do. The military must be there ONLY for the defense of the country against FOREIGN enemas - something it has NEVER succeeded in doing effectively. The military should not become a tool of a single province or ethnicity to lord over the rest of the country. The provinces should enjoy full local power - including taxation, police, education, and local legislation. The days of the One Unit and Basic Democracy crap are over. Will Pakis rise to the challenge or are we to expect more of the same? Throwing bricks, burning tires, and smashing windows are not the solution.

I think they should have ``Kafir Day`` and make it trendy and fun so the mullahs will loose their thunder. Kafir Day will be like Carnival. Before you know it ...Germans, Scandinavians will be choosing Pakistan over India. (Sorry but this Pakistani tourism schtick recently is a sad sorry imitation of India tourism dept ``Discover India``. Everyone I know has been or wants to visit India)
