The whole idea of an international war tribunal is a joke. If the aim of this court is to judge soldiers in the field by civilian standards, then it is a waste of time and effort. Soldiers, in war, commit acts that would make a billy goat puke. Granted that there are a few bad apples that need to be punished; soldiers that commit rape, massacres and other crimes, but on the whole the distinction is a narrow one. Wars are fought by ordinary people under extra-ordinary circumtances and any judgement on their actions will be biased and not not a fair one. Whose idea of a crime will the court judge and who will decide who is the quilty party. There are too many interests involved for this utopian nonsense to work. In this, as in the case of the anti-land mine treaty, I support the position taken by the United States.
