If the hijacking hadn`t happened, thats what may have happened eventually for Azhar, though for instance because judges have been under terrorist threat in J&K for the last decade or so(I wonder who does this and why?) it might have taken more time.
The process would have taken place in spite of the fact that there had been four previous attempts to release Azhar, in which a total of 5 tourists and a number of policeman were killed, another 5-6 tourists kidnapped on ( one of those times was when Omar Sheikh was captured) and a tunnel was dug beneath the Jammu jail.
Omar Sheikh`s prosecution was goofed up by the government prosecutors not the law enforcement who even got a confession from him.
And I doubt either would have gotten a death sentence awarded in India even after perfect prosecution and police work.
Hence after the Masood Azhar and Omar Sheikh grand revivals in Pakistan, one suspects the Indian govt. considers offering Pakistani killers due process a very very low priority. Moreoever, to offer due process obviously sends the wrong message to those who send them.
