The time factor is a difficult one to pin-point. I would still posit that it is but natural for them to turn on their own after the legal situation drops into a near limbo and the state is unable to establish its control. IRA kneecapping happened long before the jehadi`s were even a twinkle in reagan`s eye.

Your point about greek mythology is noted, maybe too much of an allegory there!

ICC is not an adjuticating body nor will it undertake issues relating to state terror. What it will do, provided the country has signed up, is to prosecute individuals IF the relevant state is unwilling or unable to do so. There is a very big problem which hasn’t been explored, which is how its decisions are going to be enforced. So using the ICC against the state is wrong.

I am suggesting taking the state for granted, if the state commits genocide, then there is the UNSC for it, but to go after the individuals, then the ICC will do it.

I am you must have noticed the commonalities amongst these terror groups:

1. Centralized leaderships.
2. Indoctrination through military style of training.
3. Ensuiring that all the ``policy`` and ``philosophical`` discussions are the EXCLUSIVE rights of the centralized leaderships.
4. Un-challenged Submission to Leaders` will within the cadres.
5. Create an alternative dispute resolution mechanism which is manned by their trusted persons.
5.Use brutal methods to enforce submissions to the oligopoly`s (the MOB) will (and interpretations) on the unsuspecting public.
6. Create a state within a state and ensure that the legitimate state apparatus fail to deliver.

This is how the MOBs work and they have taken a leaf out of the modern ``revolutionery`` ideologies .......if we recognize that they all are spinoffs of the fascistic ideologies then we would definitely be able to handle them with a much clearer resove!!!

This is an interesting discussion of the rationale which terrorist groups use to justify their killings – mostly of vulnerable third parties. Obviously you have given this issue some thought. The variety of examples from the world over is quite impressive.

One thing that does not jibe is the varying length of time that these groups have been in operation – some came up during the last decade whereas others (e.g. the IRA) have been around for several decades. Therefore, the phenomenon that you discuss is not a “natural” development (or it would have happened at different times in the past for different groups) rather an outcome of some other cause, perhaps the current world-wide war on terrorism.

The recommendations part of the article toward the end does not seem to have the same punch as its main body – it could have been expanded a bit to get a better balance – for example, by discussing the ICC at greater length.

The connection with Greek mythology was redundant and distracting – I have a feeling that it may have kept some readers away (it almost did that for me) – who cares who Conus was, after all? The topic is interesting on its own.

The reason the International Criminal Court does not work in these cases is that the countries, which are occupying land, never agree to take their cases there. Or will never acknowledge the rulings of the ICC. This is why the USA doesn`t even recognize the ICC.

If the ICC were to turn into an adjudicating body, the first thing any movement would do is throw their cases to the ICC. Considering the fact that research indicates that most militant struggles, including Kashmir, Ireland, Tamil, Palestine, Bangladesh etc. are actually related to occupation of land, the ICC would more than likely rule in favor of the militants. Or order some kind of a vote in the area being occupied.

For example, would India recognize a ruling of the ICC which ordered it to remove its forces from Kashmir, and agree to a vote by the locals in Kashmir.........Would the USA recognize a ruling by the ICC on its occupation of Iraq, based on the local opinions of the Iraqis. Would Israel recognize such a ruling on Palestine...........

All three of these actions already have UN rulings against them............The occupying countries never recognized them........Based on that, I doubt any of the militants would recognize them, either..........

What is needed is a worldwide movement to end State occupation of lands that belong to other people. Not a movement to furthur strengthen a State`s right to occupy others......The amounts of deaths due to State terrorism are orders of magnitude higher than those by individual terrorism - be it Iraq, Kashmir, Bosnia, Bangladesh, Palestine, Chechnya etc.
